Novia Furniture will not be able to make any changes to your order once you have signed the contract as the order will be placed into the production queue. All the products are made to order, therefore orders can not be canceled without a cancellation fee. (This also includes In-Stock and/or Display Items). The estimated delivery period is between 10-14 weeks from the invoice date stated above. However, the estimated time can be changed due to circumstances out of our control. (Pandemic, Global Shipping Crisis, etc.). Novia Customer Service will keep you informed about your order and once it is ready for delivery, Novia Furniture can not keep orders longer than 2 weeks in storage. (Additional fees may apply) For stock or display sales, the whole amount must be paid in order to avoid storage charges.

Customer(s) are responsible for all product measurements, including access to the property. The remaining balance(s) must be cleared at least 2 weeks before the delivery date in order for you to receive your items. Customer(s) accept that they have been shown a color chart including the color codes for their furniture, therefore as long as the furniture matches what is described in the invoice, customer(s) take full responsibility for what they have chosen. Customers accept that there may be a slight variance between shades of fabrics and colors due to several factors such as lighting and change in fabric rolls. The customer (s) room needs to be prepared for delivery and installation. Customers are responsible for the disposal of any packaging of delivered furniture however, our logistics team can assist if customers can direct them to a suitable disposal bin by the property. Novia Furniture Logistic Team will not be able to take any packaging back with them. Customer(s) are confirming that they are buying above stated products in the stated quantities. Nothing else or more.

 

Terms and Conditions of Novia Furniture Ltd

Thank You For Shopping with Us! Please read the instruction manual of your product(s) carefully and retain it.

1. VAT
All our quoted prices are inclusive of 20% VAT

2. Payment
An upfront deposit is required initially to place your order and to receive a formal invoice. The deposit is non-refundable. The remaining balance must be paid and cleared at least 2 weeks prior to delivery. Unfortunately, foreign credit and debit cards are not accepted as a method of payment.

3. Delivery
NOVIA FURNITURE Ltd charge for deliveries. Deliveries outside London may incur a additional charge. For details please ask a member of staff. If you believe your delivery address is outside the UK, Northern Ireland you must state this before placing an order. Upon receipt of your goods in our warehouse, we will promptly call you to arrange a suitable delivery date. You will be offered an initial delivery slot but if this is not acceptable, we will offer a maximum of two more alternatives. Target delivery dates will be arranged within our normal delivery days, times and areas and you will be notified. The room must be cleared prior to the delivery day and there must be enough space for our team of assemblers to mount and locate furniture in the room comfortably. On the delivery day our team will assemble (where necessary) goods in the room initially chosen by you and the product must be inspected by you (the customer) and notify us of any shortfalls and visible damages. We cannot accept any claim for damages where the product is not inspected at the time of delivery and if the satisfaction note has been signed. In the event that a delivery is missed, there is a charge of £45 + VAT applicable for the second appointment. Multiple deliveries may incur charges to you.

4. Delivery Dates
All delivery dates quoted at the time of your order are estimates. Whilst we make every effort to ensure we meet these estimates, it is possible that circumstances beyond our control may cause delivery dates to be changed & delayed, however, any delay in delivery dates will not entitle you to any sort of compensation. Cancellation of the order will still be subject to our cancellation policy which can be seen under the “CANCELLATION” section of the Terms and Conditions.

5. Title
Ownership of goods shall remain with “NOVIA FURNITURE LTD” and shall not pass to you until “NOVIA FURNITURE LTD” receives full payment and the delivery has been completed.

6. Storage
Once your goods arrive at our warehouse we will call to make arrangements for a delivery. We can only store your furniture in our warehouse for a maximum of 2 weeks and storage charges will incur afterwards. The pricing will be based on the value and sizes of the furniture you have purchased.

7. Disposal of Old Furniture
We do not collect or dispose of your old furniture. However, we recommend you not to dispose of your old furniture until you have been given a delivery date, in the unlikely event of a delivery problem arising we cannot guarantee a loan piece of furniture.

8. Access
We will do our best to place your goods in the desired location in your room, provided there is reasonable access. It is your responsibility to ensure that the products can be delivered to your home and to their chosen location. It is therefore essential that you discuss any possible restrictions. You should consider the vehicle access, lifts, staircases, and narrow corridors.

9. Liability for Cosmetic damages to your property during delivery
Novia Furniture Ltd does not accept liability for any marks or scratches that occur during the delivery of goods to the property. It is important to understand that despite our best efforts to safely deliver and install our furniture, minor marks or scratches can occur at properties, on floors, walls, etc. This may be due to several reasons such as access issues that fall outside of our control. Novia Furniture explicitly disclaims any liability in the rare event these issues arise.

10. Sizes And Description Of Product
All sizes quoted to the nearest cm. Size and product descriptions are given in good faith by our manufacturer information.

11. Variation In Product Specs
Due to shortages of certain new raw materials, changes in legislation, or safety requirements, some products supplied by the company may have small technical alterations and could differ slightly. The company states any changes that take place that result in product improvement in quality and equal or better standards. Occasionally, there may be slight differences in tone or shade of fabrics due to differences or changes in rolls as well as other factors such as lighting or angle of perception. Some fabrics may have natural occurrences such as marks or scuffs that may not be deemed as a fault. Ceramic products, including but not limited to dining tables, TV units, and other similar items, may exhibit variations in pattern and color due to the natural characteristics of the ceramic slab used in production. The specific section of the ceramic slab utilised can influence the distribution of colors, tones, and patterns. As a result, while the model and material of the product remain consistent, there may be differences in appearance between the final product and the piece displayed in the showroom. These variations are a natural outcome of the manufacturing process and are not considered defects.

12. Measurements
It is the customer's responsibility to measure their homes before purchasing furniture.

13. Limited Warranty
All goods are supplied with at least 5 years’ manufacturer’s warranty from the date of delivery in respect of faulty workmanship or materials. New order sofas come with a 15 year manufacturer frame warranty. Your statutory rights are unaffected. Additional charges will incur as call-out charges and spare parts for any after-sales requests after the warranty period expires. Please ask for pricing. Display items are sold as seen. It is the customer’s responsibility to inspect the product before purchasing. The warranty period for display products is 6 months from the time of delivery. The warranty will not cover any defects already displayed during the purchase. However, we may order new parts and carry out the repair work, if the customer agrees to pay towards the cost. If new damages occur during delivery or installation, these will be fully covered under the warranty.

13.1.What is not covered under this limited warranty? This limited warranty does not apply to products that have been stored incorrectly, used inappropriately, abused, misused, altered, or cleaned with the wrong cleaning methods or cleaning products. This limited warranty does not cover normal wear and tear, cuts, scratches, or damage caused by impacts or accidents. This limited warranty does not apply if products have been placed outdoors or in a humid environment, e.g. a bathroom. This limited warranty does not cover consequential or incidental damages. Please also follow the recommended weight loads. Manufacturing Process: Some products are handcrafted, and variations in stitching, seams, and tufting may occur. These are inherent characteristics of handmade furniture and do not constitute defects. Cosmetic Issues: Minor cosmetic issues such as creases, wrinkles, or irregularities in the fabric or faux leather are considered normal and are not covered under warranty. Marks and Scuffs: Fabric and faux leather sofas may occasionally have natural marks, scars, or scuffs that are inherent to the material and are not considered defects. Such markings do not affect the structural integrity of the product and are not covered under warranty. Faux Leather/fabrics: Some materials may experience fading over time when exposed to direct sunlight or harsh conditions, such as toxic cleaning routines. Fading is a natural occurrence and is not considered a defect. To minimize fading, it is recommended to place the product away from direct sunlight and to use appropriate protective measures such non toxic cleaning products. Fading is not covered under warranty.

13.2.What will we do to correct the problem? We will examine the product and decide, at our sole discretion, if it is covered under this limited warranty. If considered covered, we through our own service operations, will then, at our sole discretion, either repair the defective product or replace it with the same or a comparable product. If it is covered by this limited warranty, we will pay the costs of repairs, spare parts, labor, and travel for repair staff that we incur, provided that the product is accessible for repair without special expenditure. This does not apply to any repair work not authorized by us. Replaced parts become our property. Temporary Products: In the event of a delay or erroneous order, if a customer has been allowed to retain a product while they wait for a replacement or their own order, customers will not be entitled to compensation or refunds for the delay. The provision of temporary products is offered as a goodwill gesture to minimize inconvenience during the waiting period and does not constitute an admission of liability or obligation for compensation. By accepting and using the temporary product, the customer agrees to waive any claims for compensation or refunds related to the delay in receiving their original order. The company reserves the right to determine the suitability of temporary products and their usage during the waiting period.

14. General Care
The products supplied are to be used for the general purpose which they were designed for. All our products come with care and maintenance instructions. We will not take any responsibility for the misuse of products

15. Catalogue and Online Sales
Goods bought from our website or our catalogs may show differences in color and material as images may cause optical illusions

16. Cancelling Your Order
All of our goods are specially made for our customers therefore, once the customer gives the order, the order can not be canceled without covering the cancellation fee. The customer can cancel the order any time before the delivery, by paying %30 of the invoice (order) amount. If the customer fails to pay the cancellation fee or fails to pay the outstanding invoice amount before the delivery, NOVIA FURNITURE LTD. has the right to refer your outstanding balance to a 3 party debt collection company, and the customer will be liable for any further costs and interest. %10 compound monthly interest may be charged.

17. Returns & Refunds
Any returns and refunds should be approved by the company. If the return of goods is approved by the company, the company can refund the deposit back within 21 days. Delivered goods can not be returned.

19. Cancellation
NOVIA FURNITURE LTD. has the right to not accept or cancel an order for any reason that is not protecting the company’s interest. If an order is canceled by us, we will refund the deposit back within 21 days. New orders: Goods customized or ordered for you, may not be modified, canceled, returned, or refunded. Stock or Display: Goods purchased from our stocks or showroom displays may not be returned or refunded.

(a) In order to be able to offer you Dividebuy’s payment options, we will pass to Dividebuy certain of your personal information, such as contact and order details, in order for Dividebuy to assess whether you qualify for their payment options and to tailor the payment options for you.

4.2 We do not disclose personal data to anyone else except as set out above, where permitted by law and/or with your consent. We may provide third parties with aggregate statistical information and analytics about users of the platform but we will make sure that no one can be identified from this information before we disclose it.
